What is a Power of Attorney?
A Power of Attorney is a formal agreement giving someone else (your Attorney) the power to make decisions
on your behalf. Howeverm, that power ceases if you lose the capacity to manage your own affairs e.g.
through demential, mental illness, physical illness or accident.
What is an Enduring Power of
Attorney?
An Enduring Power of Attorney is also a formal agreement giving your Attorney the power to make decisions
on your behalf, however, that power continues even if you lose the capaqicty to manage your own
affairs.
Why should I have an Enduring Power of
Attorney?
Everyone should have one! Under an Enduring Power of
Attorney you may give your attorney the power to deal with all or any part of your financial, personal and
health matters. You cannot appoint an attorney unless you have mental capacity, hence one should be
appointed while you are healthy. A Power of Attorney is just as important as having a Will. While a
Will operates on your death, a power of attorney operates during your lifetime.
